Özet: Kurallar içinde davrandığı halde, izni verilmiş bir yapının sonradan, ‘karışıklık yaratıyor’ denerek kapatılması hukuki değildir.
Tescil ve patent gibi isim, fikir, ürün hakları ve koruma yasalarının günümüzdeki bozuşmuşluğu, etik değerleri ve felsefesi değil şimdiki konumuz; bunu tartışmıyorum. Meselem sadece hukuki bir analiz. İtalya merkezli Slow Food ve Toprak Ana Convivium (Slow Food yerel grubu) arasında sekiz yıl önce yaşanan süreç…
Dünya Conviviumlar Haritası; Terra Madre toplantısı, Torino – İtalya (2008). Toprakana – Istanbul Convivium kurulduktan yaklaşık 2 yıl sonra.
Adım adım gideceğim.
1. Ne şekilde bir Convivium kurulabileceği aşağıdaki dokümanda yer alıyor:

Bu dokümanda Convivium isimlendirme kuralı olarak (*), bağlı bulunulan bölge, şehir ve/veya semt adlarının verilmesi gerektiği ifade edilmiş. Ancak, dünyanın farklı ülkelerinde olduğu gibi (örneğin, Peru), Türkiye’deki mevcut Convivium’lar içinde de, bölge isimlerine ilave olarak farklı tematik isimler içeren Conviviumlar da mevcut (link).
(*) The name of your convivium should contain a geographical reference of the locality of where you live and where you will be undertaking the Slow Food activities, eg a town, a village, or a city name, but not a province or state or country. If you open a convivium in a large city (more than 300,000 inhabitants) you are required to add something to the name of your city – a neighbourhood, suburb, zone or quarter of the large city (e.g. “Bordeaux-Aquitane Convivium” or “Les Bitourges Vivisques- Bordeaux Convivium”), as there may be existing convivia in the area or other convivia opening in the future.
2. Ocak 2007 tarihinde önerdiğim ”Istanbul – Toprak Ana” ismi Slow Food – İtalya merkezi tarafından, Türk delegasyon aracılığı ile (‘Toprak Ana’ kelimesinin anlamı bilinerek) onaylandı ve önerdiğim şekilde Istanbul – Toprak Ana Convivium resmen kuruldu.
3. Ekim 2009 tarihinde (Istanbul – Toprak Ana Convivium resmi onay tarihinden 2 yıl sonra), İtalyan yönetici tarafından bana ulaşan e posta şöyle diyordu:
(…) The reason why I am sending this email is because it has come to our attention that your convivium name, Toprak Ana, inappropriately uses and without permission the Slow Food registered trademark derivative, Terra Madre.
(…) I would like to direct your attention to the International Statute that clearly shows that Slow Food derivative trademarks, such as Terra Madre, may only be used by convivia if they have been granted permission to do so in writing.
The Code of Use for Slow Food Logos defines the rules governing the use of Slow Food trademarks. These rules must be applied, except where explicitly specified otherwise by the Code, for the Slow Food logo and name and also all of its derivative trademarks, i.e. all trademarks, registered or based on the Slow Food logo, which identify specific projects and events organized by the Slow Food Association (Terra Madre, Ark of Taste, Presidia, Slow Food Award, Salone del Gusto, Cheese, Slow Fish, Slow Food on Film)… The International Board of Directors is the body of Slow Food which exercises this authority, and therefore has the final responsibility for enforcing the Code throughout the world…This authorization must always be granted in writing when one of the organizations listed above is established.
I am sure you will understand that the International Board of Directors need to amend the current situation as soon as possible in order to comply with the International Statute of Slow Food. Therefore, I hereby notify you that your convivium may no longer call itself Toprak Ana, and thus recommend that you hold a convivium congress immediately to elect a new convivium committee and choose a new name containing a geographical reference to your location. Then you must resubmit your request for authorization by signing a new foundation protocol by October 31st, 2009. I am sure you will understand this need to comply with our statute, and to avoid the dissolution of your convivium.

4. Slow Food tescilli markalarının kullanım kuralları (CODE OF USE FOR SLOW FOOD TRADEMARKS)

Yukarıdaki link içinde ”Toprak Ana” isminin kullanımını kısıtlayan hiçbir ibare yer almıyor. Daha genel bir ifadeyle, dokümanda belirtilen tescil edilmiş isimlerin (Terra Madre, Ark of Taste, Slow Food Presidia, Salone del Gusto, Cheese, Slow Fish) başka dillerdeki karşılıklarının izin verilmez olduğu yazmıyor. ”Derivatifleri” kullanılmaz denmekte, bu ifade bir başka lisandaki karşılığı demek değil.
Bunun ötesinde, ”tescilli isimlerin kullanım hakkının kaybedilmesi” (**) bölümündeki hiç bir madde, kullanımı resmi izin ile başlayan, tüm faaliyetlerinin Slow Food felsefesi ile uyumlu olduğu tüm Slow Food yetkilileri tarafından defalarca teyit edilen ”Istanbul Toprak Ana Convivium” isminin değiştirilme zorunluluğunu getirmiyor. Hukuki zeminde belirlenen tüm yazılı kurallara göre kurduğumuz Convivium, en başından itibaren kurallara asla aykırı olmadı.
Aşağıdaki paragrafta, e-posta mesajındaki ifadeler hatalıdır, kabadır, adil değildir:

Bu cümleyi inceleyelim:

Slow Food tarafından iki sene öncesinde resmi izni verilen ve defalarca resmi davetlere katılmış bir ismin dikkatlerini henüz çekmesi; henüz fark ettik anlamında.
İsterseniz bir ara verelim ve 2007’de Meksika’nın Puebla kentinde gerçekleştirilmiş olan Slow Food Dünya Kongresine bakalım:
”… Toprak Ana, inappropriately uses…”
Uygunsuzluğa ait yazılı bir kural yok. ”Toprak Ana” hiçbir şekilde Slow Food tescilli markalarından veya kendi deyimleriyle derivatiflerinden biri değil.
”… without permission…”
Resmi izin Slow Food Italya tarafından verilmiştir. Bu isim altında Istanbul – Toprak Ana Convivium, Slow Food tarafından adımıza gönderilen para makbuzları ile üyelerinden bir yılı aşkın bir süre tahsilat yapmıştır.
”… registered trademark derivative, Terra Madre.”
Toprak Ana, Terra Madre’nin bir başka dildeki karşılığıdır. Derivatif değildir. Slow Food yönetmeliklerinde ilgili tarihlerde, yabancı dillerde Terra Madre’nin yerel dilde kullanımını kısıtlayan hiçbir kural yoktu.

(5. LOSS OF RIGHT TO USE THE TRADEMARK)
The Executive Committee has the exclusive authority to revoke the right to use the Slow Food trademark (and its derivatives) from any party previously granted the right under the provisions of this Code. The Executive Committee revokes authorization to use the trademarks in the following cases:
– If the National Statute of a National Association does not specifically comply with Article 17 of the International Statute.
– If any local body of the Slow Food organization promotes activities and initiatives which have no connection with the Slow Food movement, and/or which involve entities, companies or associations which are in obvious conflict with the Slow Food philosophy.
– If any local body of the Slow Food organization uses the international Slow Food trademark without having requested authorization from the Executive Committee, or if authorization has been refused.
– If any third party has an economic relationship with the Slow Food organization. Revoking of authorization of use of the trademark by the Executive Committee must be made in writing (recorded-delivery letter, fax or e-mail).

Dear Cem,
There has indeed been some controversy regarding the name of your convivium. There has not been, however, any doubt of your work to promote good, clean and fair actions for both production and consumption. Please rest assured that we know the great efforts and passion you are putting into your work with small farmers and sustainability, and we thank you for your dedication.
To begin with, the name Terra Madre is an internationally registered trademark, as is Slow Fish for example. This means that convivia are not able to use these names unless permission is granted by the International Board of Directors (see Code of Logo Use attached). Had the geographic coordinator at the time you sent your first protocol understood Turkish, this name most likely would not have been allowed. It has since come to the attention of non- Turkish speakers as well that the name Toprak Ana means Terra Madre.
Secondly, it is controversial that Toprak Ana is related to a certain extent of business and commercial activity related to your own personal work. We understand that your work is honourable and promotes the activities and vision of the Terra Madre network, however there becomes a certain potential for criticism and conflict of interest when a convivium name in particular is related to the convivium leader’s business, enterprise, or any profit making. A restaurant owner for example could not call their convivium after their restaurant, nor should a farmer name the convivium after his or her farm.
In general, to avoid all controversy and criticism and to be aligned with the direction put forth at the last International Congress in Puebla, all convivia should have a name the represents their geographical area.
As this seems to be a sensitive issue, I think it would be best to be taken up with the International President and Board of Directors for their final decision.
In order to handle this it would be most suitable if you would write a letter for their review regarding not only Slow Food Toprak Ana as a convivium, but also Toprak Ana as a registered name and trademark relating to the online producer sales initiatives, the radio programme and any other activities.

Slow Food, bu kurum adına yakışır şekilde yaşamını sürdüren üreticileri içinde barındıran bir kurum. Taşıdığı ve markalaştırdığı ticari kimliğin (veya kişisel isimin), convivium adı olamayacağı ilk kez yukarıdaki eposta mesajında ifade edildi. Daha önceki tarihe ait hiç bir yazılı dokümanda böyle bir kural yok.
Slow Food bir vakıf. Bu vakıf içinde gelir kalemleri yer alabilir. Ticari demek illa sömürü demek değil ki… İyi niyetlerle, daha güzel bir geleceğe hizmet verebilen işlerle yapılan çok farklı ticari modeller mümkün. Örneğin, Slow Food’un gerçekleştirdiği en önemli projelerden biri olan Gastronomi Bilimleri Üniversitesi (UNISG).
2004’de kurulan üniversite dünyanın tüm ülkelerinden gençlerin bir buluşma yeri. Gıdanın tohumdan başlayan serüvenini, gelenekselliğin yanısıra bilimsel araştırmalar eşliğinde buluşturan, yemek kültürünün korunması kadar dönüşümündeki felsefeleri de tartışan kurum. Başarılı mı? Talep ettiği yıllık bedeli hak ediyor mu? Bu da elbet tartışılır. Örneğin, okulun akademik açıdan güçlü olmadığını düşünenlerden biri Crystal Cun. O da bir çoğumuz gibi kent – köy değerlerinin uç sınırlarında gezinmiş, deneyim sahibi olmuş. Sevgisi kadar eleştirisi de saygıyla (link). Elde edilen maddi gelirin yöntemi (bağış, lokanta, turizm, okul, kitap, reklam, vb), kaynağın miktarı (örneğin; bütçe fazlasının değerlendirilmesi), hedefleri… Hepsi sorgulanabilir.

Ötesini hiç görmek istemeden, ”o isim altında ticaret yapıyor musunuz?” sorusunun sığlığına sığınmak böylesi bir kuruma yakışmaz. ”Slow Food” adını içeren lokantaya izin var (örnek, link); ancak yerel üreticinin kendi ürettiği ticari marka altında bunu Slow Food ile ilişkilendirmesi yasak. Üstelik hiçbir yazılı kural öne sürülmeden, gelen bir e-posta mesajıyla…
Oyunun kurallarının yola çıktıktan sonra tek taraflı değiştirilmesi hukuka ve kişilere saygılı olamaz. Öte yandan, ticareti engellerken, kapitalizm dünyasının güçlü isimlerinden bağış kabul etmek Slow Food felsefesi açısından sorun değil mi? Slow Food, conviviumlarının bu hatayı yapmadığından emin mi?..
Yukarıdaki e-posta yazışmamıza geri dönelim:

Ne yazık ki, bu iddia da gerçeği yansıtmıyor. Bölgemiz koordinatörü türkçe biliyordu. Ayrıca cümle içinde geçen ”most likely” ifadesi, konuyla ilgili genel kuralsızlığın ve keyfiyetin bir göstergesi.

Following our application, the official SF International commitee did not make an issue to ask what does “Toprak Ana” mean. Hence, nobody asked me to change the name at that time. Today, there still exists a given official right and this must not be cancelled after years.
Toprak Ana is a precious local word that we want to conserve. Any need to change the convivium name will cause severe damage regarding our present activities and respect we have builded for Slow Food, in Turkey.
I re-request your best approach to allow us to continue as is.

We recognize and appreciate all of the efforts of you and your members to share and promote the Slow Food philosophy. However, we can no longer permit your authorization to use the Slow Food Toprak Ana name and logo. This name conflicts with the Terra Madre registered trademark and network and creates certain confusion amongst the international, national and local food communities and convivia.
I regret to inform you that we should proceed now closing Slow Food Toprak Ana convivium. The members will be given the opportunity to transfer to another convivium in the upcoming days.
